  1. General Information
    1. Application of this Privacy Policy. This Privacy Policy is formulated in accordance with the Personal Data Protection Act 2010 (“Act”) and explain how Propface Sdn. Bhd. and its related companies (individually or collectively referred to as “Propface”, “we”, “our” or “us”) collect or use or handle your personal information, including your sensitive personal information (“personal data”).
    2. Our Commitment. Propface is committed to protect the privacy of the personal data that we gather and this Privacy Policy explains how and why we collect, use, disclose and/or process your personal data, the parties that we disclose the personal data to, how you can access and correct your personal data in compliance with the Act.
    3. Amendment of this Policy. Propface reserves the right to amend this Privacy Policy from time to time without prior notice. If we decide to modify, add or remove portions of this Privacy Policy, we will notify you of the updated Privacy Policy via email, by our website or any other suitable communication methods.

    1. Types of Personal Data We Collect. The types of personal data (includes sensitive personal data) that we may collect, use, disclose and/or process include:-
      • full name, personal identification number of individual, mobile or residential telephone number;
      • personal email address and/or residential address;
      • financial data such as bank account numbers and/or credit card details;
      • monthly or yearly income, employment, job status, educational background;
      • photograph, video image or voice recordings of individuals;
      • age, birth date, gender, star signs or zodiac;
      • data relating to individuals provided to Propface directly through its websites or indirectly through use of Propface’s websites, through Propface’s third parties or otherwise;
      • data from access to or usage of Propface’s facilities and/or resources;
      • cookies, pixel tags, web beacons, IP addresses and navigational data;
      • resume or CV’s when you apply job with us;
      • company’s credit reference and also business details such as business registration number and business industry; and

If you provide us with any Personal Data of another person (for instance, a family member, business associates), you are responsible for ensuring that such person is made aware of the information contained in this Privacy Policy and that the person has given you his or her consent for sharing the information with Propface.

    1. Source of Personal Data. We may collect your personal data from the following sources:-
      • information provided by you and/or by other relevant third parties submitted by you for the purpose of quotation, tender, request for proposal, engaging our services;
      • information provided by you and/or by other relevant third parties when you register for or use any of our services on websites owned or operated by us or when you register as member, associate or any other registration we had provided under websites owned or operated by us;
      • information provided by you and/or by relevant third parties when you use our services such as the “Feng Shui Mapping” and “Propfits” features;
      • information provided by you and/or by relevant third parties when you commence a business relationship with us (for example, as a service provider, business partner, vendor or contractor);
      • information provided by you while you interact with us via social media, corporate events, visit or browse our websites;
      • information provided by you while you respond to or interact with our marketing representatives or agents, promotions or other marketing initiatives;
      • information provided by our business associates or third parties;
      • image recorded through CCTV or other electronic media;
      • any other information which you have provided to us by whatsoever means and/or in whatsoever manner; and
      • information obtained independently by us or given to us from other lawful sources such as public websites and social media.
  4. Why We Collect Your Personal Data
    1. Use of Personal Data Collected. We will or may collect, use, disclose and/or process your personal data for one or more of the following purposes:-
      • to process your application for the services we are providing on our website;
      • to facilitate the proper and effective usage of our website and services we are rendering;
      • to maintain your account with us and monitor your account activity;
      • to comply with or enforce the terms and conditions of any agreements (including the Website Terms of Use and Member and Associate Terms and Conditions);
      • to verify your identity or carry out due diligence or other screening activities (including background checks) in accordance with legal or regulatory obligations (whether Malaysia or foreign country) applicable to us or our affiliates or associated companies;

      • to conduct market research, market and business analysis, customer analysis, customer demographics, customer preferences and other relevant data for the development and improvement of our services; and

    1. Disclosure to Third Parties. We may share your personal data with third parties, where applicable, whether within or outside Malaysia. These disclosures are made subject to suitable protection for privacy and confidentiality being in place. The third party organizations to which we would usually disclose your information include:-

    2. Extent of Disclosure.We will only disclose the minimum amount of information which we deemed necessary for the purpose and we will take all appropriate safeguards to ensure the integrity and security of the personal data.

      • the disclosure was requested by regulatory, statutory authority or as required by a court order.

    1. Permitted Transfer. We may transfer your personal data to places outside Malaysia with sufficient data protection laws if necessary when carrying out any of the purposes stated herein.
    2. Assurance. We would take reasonable precautions to ensure personal data will not be processed in any manner contravenes the Act.
  7. Right to Access & Correct Your Personal Data
    1. Rights of Access and Correct. You have the right (subject to certain exceptions and conditions, set out in applicable law) to:-
      • request access to your personal data that we process about you and certain information on such processing;
      • request rectification of your personal data or completion of any of your personal data that would be inaccurate or incomplete;
      • request erasure or deletion of your personal data that would no longer be necessary to achieve the purposes;
      • request a copy or the portability of your personal data that you have provided to us. We will make every endeavour to ensure your personal information is accurate and up to date therefore we ask that if there are changes to your information you should notify us directly.
    2. Accuracy of your Personal Data. It is important that you advise us of any changes to your personal data or if there are any errors in the personal data we hold about you. We will not be responsible for relying on inaccurate or incomplete personal data arising from the personal data that you had initially provided us with.
  8. How Your Personal Data is Stored and Managed
    1. Practical Steps to Safeguard. We would take the necessary precautions and practical steps within the capability of Propface to safeguard your personal data against any loss, theft, unauthorized access and/or destruction.

  9. Retention of Personal Data
    1. Retention Period. We shall retain the personal data which you provide to us for a reasonable amount of time based on the following retention criteria:-
      • for as long as it is necessary to fulfill the commercial purposes as required;
      • for as long as it has an ongoing relationship with you;
      • under the legal obligation to do so; and
      • to safeguard or improve Propface’s legal position (for examples regulatory investigation, litigation or statutory limitation).
    2. Retention of Anonymised Data.We may retain your personal data for statistics, reference, analysis or study provided that your personal data has been anonymised.
  10. Your Consent
    1. Your Consent. Please refer take note our “Website Terms of Use” and “Member and Associate Terms and Conditions” whereby by accessing and using our services, it would be deemed that you agree with and consent for us to process or continue to process your personal data in accordance with the terms herein. We have the right to request that you provide a declaration expressing and affirming your consent for us to process your personal data in the prescribed form provided by us.
    2. Obligation to Provide Consent. You have no obligation to provide any of the personal data requested by us. However, if you choose not to provide us with certain personal data, we may not be able to deal with your request, and/or provide you with the goods or services in which we will need such personal data to perform or discharge our services or responsibilities diligently.
    3. Consequences on Withdrawal of Consent. Please be noted that your withdrawal of consent could affect our relationship, how we to fulfil our obligations to you or the proper performance of our services, depending on the extent of your withdrawal.
    4. Right to Withdraw Consent. You may withdraw your consent for us to process your personal data by submitting the your request to our Data Protection Officer. Upon receiving your notice withdraw your consent to process your personal data, we may still process your personal data if the withdrawal of consent would affect the rights and our obligations under contract or legislation as follows:-
      • the right to use and access our services or websites;
      • the right to bring and maintain legal proceedings against you;
      • the right to commence and maintain with internal investigation involving yourself;
      • any obligations as provided under any relevant laws; or
      • the right to conduct of internal audits, risk management and/or legal or regulatory reporting requirements.

  12. Conflict
    1. Events of Conflict. In the event, if there is any conflict between this Privacy Policy in English language and the relative Privacy Policy in Bahasa Malaysia language, the terms in the English Privacy Policy shall prevail.
